Terms of service

1. Overview

This website is operated by Shonen Society. Throughout the site, the terms “we”, “us” and “our” refer to Shonen Society.

By accessing our website or purchasing from us, you agree to be bound by these Terms and Conditions, together with our Returns and Refunds Policy, Shipping Policy and Privacy Policy, which form part of this agreement.

If you do not agree to these Terms and Conditions, you must not use our website or services.

Nothing in these Terms and Conditions excludes, restricts or modifies any consumer rights or remedies available under Australian Consumer Law or other applicable mandatory consumer protection laws.

2. Eligibility and Use of the Website

By using this website, you confirm that you are at least the age of majority in your place of residence, or that you have obtained consent for any minor dependants to use the site under your supervision.

You must not use our website or products for any unlawful, unauthorised or prohibited purpose, including infringement of intellectual property rights or violation of applicable laws.

You must not transmit viruses, malware or any code of a destructive nature.

3. Orders and Contract Formation

Placing an order on this website constitutes an offer to purchase.

A binding contract is formed only once your order has been accepted and dispatched by Shonen Society.

We reserve the right, to the extent permitted by law, to refuse, cancel or limit any order prior to dispatch, including where:

  • products are unavailable
  • pricing or system errors occur
  • payment cannot be verified
  • fraudulent or abusive activity is suspected
  • promotions or purchase limits are misused

If an order is cancelled before dispatch, a full refund will be issued.

4. Pricing, Errors and Availability

All prices are subject to change without notice.

While we take reasonable care to ensure accuracy, errors relating to pricing, descriptions, promotions, availability or shipping information may occur. We reserve the right to correct such errors and cancel affected orders prior to dispatch.

5. Promotions, Discount Codes and Sale Items

Discount codes and promotional offers:

  • must be applied at checkout
  • cannot be applied retrospectively
  • cannot be reapplied once a promotion has ended

If an item purchased on sale or with a promotion is returned, any refund or store credit will reflect the price actually paid, not the original full price.

We reserve the right to suspend, withdraw or restrict promotions at any time, including where promotional abuse, code sharing or misuse is identified.

6. Products and Product Information

Some products, including limited drops and special releases, may be available in limited quantities or for limited periods.

We make reasonable efforts to display product colours, sizing and images accurately, however variations may occur due to lighting, photography or device settings.

Product measurements may vary within normal industry tolerances.

7. Returns, Refunds and Exchanges

Returns, refunds, store credit and exchanges are governed by our Returns and Refunds Policy.

Change of mind or sizing returns may be eligible for store credit or exchange, subject to approval and policy conditions.

Faulty item remedies are provided in accordance with Australian Consumer Law.

8. Shipping and Delivery

Shipping methods, delivery timeframes, split shipments, customs matters and delivery responsibility are governed by our Shipping Policy.

Delivery timeframes are estimates only and commence from the date of dispatch.

Risk of loss transfers to the customer once an order has been delivered to the address provided at checkout, subject to rights under Australian Consumer Law.

9. International Orders

International customers are responsible for any customs duties, import taxes or fees imposed by the destination country.

Failure to pay required customs charges may result in delays, returns or abandonment of the shipment, for which Shonen Society is not responsible.

Nothing in these Terms limits mandatory consumer rights applicable in your country of residence.

10. Personal Use and Resale Restrictions

Products are supplied for personal use only.

Unauthorised resale, commercial use or distribution of our products without prior written consent is prohibited.

We reserve the right to cancel orders, refuse service or suspend accounts where resale or bulk purchasing activity is identified.

11. Fraud, Chargebacks and Misuse

We reserve the right to cancel orders, suspend accounts or refuse service where fraudulent activity, unauthorised transactions or chargeback abuse is suspected.

Use of bots, automated systems or software to access the website, place orders, bypass limits or interfere with site functionality is prohibited.

12. User Accounts

If you create an account, you are responsible for maintaining the confidentiality of your account details and for all activity conducted under your account.

We are not responsible for unauthorised access resulting from your failure to secure your account credentials.

13. Intellectual Property

All intellectual property rights in this website and its content are owned by or licensed to Shonen Society, unless otherwise stated. Our designs may be inspired by popular culture, art or animation.

Our website may contain links to third-party websites or tools provided “as is”.

We are not responsible for third-party content, policies or transactions.

15. User Submissions

Any feedback, comments, reviews or submissions you provide may be used by us without restriction or compensation.

You are solely responsible for the content and accuracy of your submissions.

16. Disclaimer of Warranties and Limitation of Liability

Nothing in these Terms excludes any non-excludable consumer guarantees under Australian Consumer Law.

To the extent permitted by law, our website, services and products are provided “as is” and “as available”, without warranties of any kind.

We are not liable for indirect, incidental or consequential losses arising from use of the website or products, except where liability cannot be excluded by law.

17. Force Majeure

We are not liable for delays or failures caused by events outside our reasonable control, including natural disasters, carrier disruptions, industrial action, government action or internet outages.

18. Indemnification

You agree to indemnify and hold harmless Shonen Society from claims arising from your breach of these Terms and Conditions or violation of applicable laws.

19. Termination

These Terms and Conditions remain effective unless terminated by you or us.

We may suspend or terminate access where these Terms are breached.

Clauses relating to intellectual property, limitation of liability, indemnity and governing law survive termination.

20. Severability

If any provision is found unenforceable, the remaining provisions remain valid.

21. Entire Agreement

These Terms and Conditions, together with referenced policies, constitute the entire agreement between you and Shonen Society.

22. Governing Law
